    I am an attorney with a financial banker and a real estate development company that wants me to start a title company to perform their closing and do legal work. They are providing the support team. I just want to cover all of my bases before I agree to help set this up. I have talked to a bunch of title agents, but I would love to have a clear beginning plan. We are in TN. I don't plan to be seeking other clients as that is not our business arrangement at this time.     I purchase tax deed certificates in texas. They have a right of redemption of either 6 months or 2 years depending what kind of properties. I Only purchase 6 month right of redemption properties, I have 8 properties in escrow now but can not get title ins. I have told title company they dont have to provide me title ins just tell me if i have clear title and they tell me they will not provide me that for 2-4 years. So i would like to start a title company to state if their is clear title and/or to provide title ins. I will have all the clients i need because no other title company will do it.

    I've assisted 8 companies in two states getting their title companies set up this year alone. I think I am going to become licensed to produce title insurance in every state and set up another business with nothing but mobile notaries for each state and schedule closings in all states. Can someone send me the information to do all this for each state and what the requirements are for each state? While you're at it. how about each country? Geez people...look up stuff yourself. It's not that hard!

    I am a real estate & business attorney licensed in MD and stumbled across this site while researching cloud-based title software. I realize attorneys are not the most loved professionals on the planet but feel compelled to offer a note of caution. Many title companies who road on the wave of the real estate bubble are now defunct and some facing serious back-lash from loose practices. One must at a minimum understand the law! In my state, no one can conduct a lender closing without being a licensed title producer. So mobile notaries are out unless they are separately licensed as title producers. This is not a difficult license to obtain, but it certainly involves a bit of preliminary leg work. No one can prepare a deed in this state for a closing unless they are a licensed attorney, so one can't simply open up shop without having the licensure and relationships with professionals in place. After one obtains licensure, then the normal business steps of forming an entity, setting up tax accounts, etc. apply

    Maryland lawyer says it best. Title insurance is a very difficult business to make a profit. Liabilities are high, margins are low. I acquired an existing company in 2008, and managed to survive the great recession. I have extensive examination and management experience, and hired competent employees. Also, the title plant is extremely important. Too many companies start with thin plants instead of complete sovereignty plants because of the expense and loose regulations that allow thin plants in the first place. Good luck ever closing a huge ranch deal without a title search to at least 1900! You must be a competent real estate attorney or retain one. You must carry expensive errors and omissions insurance, regardless of whether its required by a governmental agency or an underwriting company, because one lawsuit on a large deal can sink you. Finally, I believe it's best to concentrate on the title insurance business if you're in it...don't try to own a real estate company or construction company as well...if so, you are asking for trouble and will get your just reward for your greed!

    I am in NY Currently a Real Estate Broker that was hired by an attorneys firm to restructure their business of Foreclosure Defense. Although they are doing great in this business I am looking to set up a title company that can take the chain of title issues that have arises out of the foreclosure litigation audits that are conducted.
