The judged has dismissed the case filed by Cook County Sheriff Thomas Dart against the online giant, saying that offering service such as erotic dancing is not prostitution. Popular online classified ads website Craiglist.com has scored a legal victory against its detractors following a decision rendered by a US District Court judge in Chicago.
The court dismissed the case, saying that the online giant is now a source of prostitution. In his decision, US District Court Judge John Grady ruled that Craigslist does not encouraged the use of its service for online prostitution, adding that the website operators may even be able to ask for its right for freedom of speech under the limited protection of the constitution. The court documents also stated, “That a woman or a man advertising erotic dancing for their clients is an offer of an adult service over the Internet. Yet, it may still not be considered as prostitution.” “The plaintiffs can not sue Craigslist based on the observation of the court under any circumstances,” the court added. The high profile case stemmed from a complaint filed by Cook County Sheriff Thomas Dart in March 2009, saying that the online classifieds website supported the sex industry and profited from massive cash exchange.Based on records, Craigslist has some 50 million loyal visitors in a month. Dart said that he filed the case because it is under his jurisdiction to investigate cases such as prostitution in his district, including those of Chicago. COMMENT
