Chevron Tags Ecuador in $27-Billion Pollution Case

Chevron Seeks Share Liability with Ecuador for Trade Violations


Summary: Chevron on Wednesday has filed a third case against Ecuador seeking for share liability for the alleged trade violations that it has committed.

Chevron said that Ecuador has partnered with Texaco, its subsidiary, during its operations in the Amazon rainforest, adding that the responsibility should not be shouldered by them alone.

Chevron Corp. has filed on Wednesday an international arbitration case against Ecuador, which seeks equal liability to the $27 billion lawsuit over the damage caused by Texaco in the Amazon rainforest between 1964 and 1990.

Based on the documents, Chevron accused Ecuador of grave trade violations after it allegedly hid behind the law suit it has filed against Texaco, which was then acquired by the oil giant in 2001.

As part of the 1998 agreement with the government, Texaco has spent million of dollars to clean up the Amazon region, which was extensively affected by its operation in the said years.

But Chevron pointed that it was not Texaco’s sole liability to clean the Amazon since it has partnered, during the same period, with Petroecuador, a state-owned oil company. Chevron said that Petroecuador continues to pollute the water basins in the region long after Texaco departed from the partnership.

In 1993, Chevron has filed a lawsuit against Ecuador for the same reason. The ruling on the case is expected to come out in the coming months.

The latest lawsuit was the third attempt of Chevron to enjoin Ecuador in the environmental violation case.

But Ecuador lawyers said that it is ironic for the oil company to file another case against them when the ruling on the New York case is about to come out any time soon.
